60-Day Home Trial Agreement

Lumo SafetyLight — 60-Day Home Trial Agreement

Version: July 31, 2026 · Effective upon your acceptance at checkout.

Thank you for joining the Lumo SafetyLight 60-Day Home Trial.

This Agreement explains how the trial works, what happens at the end of it, how we handle your information, and what we ask of you as a participant.

By placing your trial order for the Lumo SafetyLight and completing setup, you agree to the following terms:

1. What the 60-Day Home Trial Is

The 60-Day Home Trial lets you use the Lumo SafetyLight and SafeWatch text-alert service in your own home for 60 days, so you can decide whether it's right for your family. The trial is free apart from a one-time $7.95 shipping & handling fee to send your device (see Section 8); there is no cost for the device or the SafeWatch service during the 60 days, and no further charge unless you choose to continue. Participating families also help Nomo Innovations LLC learn how the product performs in real homes ahead of wider release.

2. What the Lumo SafetyLight Does

The Lumo SafetyLight is a plug-in (110V) nightlight with a passive infrared (PIR) motion sensor. It has no camera and no microphone. During the SafeWatch service, it provides up to three automatic daily check-ins to the one or two caregiver cell number(s) you enroll:

·            Two SafeWatch windows you set — an AM and a PM monitoring period (for example, 7–9 a.m. and 6–9 p.m.). If no movement is detected during a full window period, you receive an immediate heads-up text.

·            A nightly 9 p.m. recap — a passive summary that includes the time of the most recent detected movement (for example, "last movement 8:42 p.m.").

The monitored person does not answer or interact with anything — monitoring is fully passive. The nightlight is fully adjustable or can be turned off while monitoring continues. Pet Shield is included to reduce false readings from pets, and an optional stick-on wall mount is available.

3. Early-Production Units

The units provided in the 60-Day Home Trial are early-production units. While fully functional, they may contain software or hardware refinements still in progress and are provided on an "as is" basis (see Sections 11 and 14).

4. Limited Availability

Participation in this round of the 60-Day Home Trial is limited to the first 50 households and is offered for a limited time. Units are distributed on a first-come, first-served basis, and enrollment for this round closes automatically once all 50 units are claimed

5. Eligibility to Participate

To keep the trial meaningful and appropriate, by enrolling you confirm that:

·            You will use the Lumo SafetyLight to monitor a loved one who lives alone, or who is regularly home alone while you or another caregiver are away, in a normal household environment; and

·            The person whose home is monitored is aware of, and consents to, the activity monitoring (see Sections 11 and 12).

6. Duration and Ownership of Hardware

The trial period lasts 60 days from device activation. The hardware becomes your property upon completion of the 60-day trial period, whether or not you continue any subscription — unless you choose to return it (see Sections 7 and 17). After the trial you may continue using the device with or without the SafeWatch service, or stop at any time.

7. What Happens at the End of the Trial — Continuation and Billing

Participation in the 60-day trial is free. Near the end of your 60 days, we will email you a reminder explaining your choices:

·            Continue SafeWatch — $4.99/month. If you'd like to keep the SafeWatch monitoring windows, heads-up texts, and nightly recap, you affirmatively choose to subscribe at $4.99 per month. You may cancel anytime through a self-service cancellation link, with no cancellation fee.

·            Keep the nightlight, no subscription. If you do nothing, you are not charged. The Lumo SafetyLight is yours to keep and continues to work as a nightlight; the SafeWatch monitoring, heads-up texts, and nightly recap simply turn off without an active subscription.

·            Return it for a refund of shipping. You may send the device back before your trial ends, for any reason, using a prepaid return label we provide, and we will refund your $7.95 shipping & handling fee (see Section 17).

How billing works. Your payment method is securely saved by our payment processor when you enroll, so that continuing is a single step. It is used to collect the one-time $7.95 shipping & handling fee at signup, and is charged the $4.99/month subscription only if you affirmatively opt in at the end of your trial. If you do nothing, your saved card is not charged and no subscription begins.

8. Shipping & Handling

The 60-day trial itself is free. To start it, you pay a one-time $7.95 shipping & handling fee at checkout, which covers the cost of sending your Lumo SafetyLight to your home. This is the only charge to begin the trial — there is no cost for the device or the SafeWatch service during the 60 days. If you return the device before your trial ends using the prepaid return label we provide (see Section 17), we will refund the $7.95 shipping & handling fee. If you keep the device — whether or not you continue the SafeWatch subscription — the $7.95 covers delivering the device to your home and is not separately refunded.

9. Participant Responsibilities and Surveys

By joining the 60-Day Home Trial, you agree to:

·            Use the Lumo SafetyLight in a normal household environment.

·            Complete three short monthly check-in surveys (about five minutes each) so we can learn how Lumo is working for your family.

·            Report any product issues, defects, or unusual behavior to support@lumosafetylight.com.

·            Allow limited, anonymous device-health data (for example, error logs, connectivity status, and uptime) to be collected for reliability analysis, as described in Section 11.

·            Confirm you are authorized to enroll the caregiver cell number(s) you provide, and that the person whose home is monitored is aware of and consents to the activity monitoring (see Sections 8, 9 [resident consent], and 10).

Participation is voluntary and may be ended at any time by contacting support.

10. Testimonials and Use of Feedback

Any feedback or survey responses you provide may be used to improve our product and service. Separately, we may ask whether you'd be willing to share your experience publicly. We will not use your name, likeness, or a quotation attributed to you in marketing without your separate, explicit written permission, and we will only use testimonials in a way that is truthful and consistent with what Lumo actually does (activity awareness, not medical or emergency claims).

11. Consent to Text Messages (SMS)

The SafeWatch service works by sending text messages to the caregiver cell number(s) you enroll. By providing those number(s), you confirm you are authorized to enroll them to receive Lumo's recap and alert texts. Message and data rates may apply, and message frequency varies.

12. Monitored Resident Awareness and Consent

Lumo detects activity inside a person's home. When you set up the device, you confirm that the monitored resident is aware of, and agrees to, this activity monitoring. Lumo collects only anonymous in-home motion activity and the caregiver number(s) you enter — it does not collect the resident's name, address, or phone number, and it has no camera or microphone.

13. Data and Privacy

Motion-activity events and timestamps are evaluated and stored on the device, in the resident's home — not copied to our servers. The only thing that leaves the home is the resulting recap or alert text, sent to your caregiver number(s) through our text-message provider.

The device has no camera and no microphone. It does not collect images, video, or audio, and it does not identify who moved — only that movement occurred. To keep units working, the device sends us limited device-health data such as error codes, connectivity status, uptime, firmware version, and a count of texts sent. This is operational data about the device, not the resident's activity log or the content of any text.

Any feedback or survey responses are stored securely and used only to improve our product and service. We do not sell participant data. Your information is handled as described in our Privacy Policy, which governs in the event of any conflict with this Section. We keep device-health diagnostics and account records for 90 days. You may request access to or deletion of your information at any time by contacting support@lumosafetylight.com. Depending on where you live (for example, California under the CCPA/CPRA), you may have additional rights.

14. Nature of the Alerts — Activity, Not Wellbeing

Lumo reports activity, not wellbeing. A recap or window confirms that a room saw normal movement — it does not confirm that a person is okay, healthy, or safe. Detected motion is not a medical or wellbeing determination, and the absence of an alert is not assurance that anything is fine. Alerts and recaps are intended only to provide informational awareness and peace of mind, and should never be relied upon as the sole means of monitoring a person's safety, health, or wellbeing.

15. Product Disclaimer

The Lumo SafetyLight provided in this trial is an early-production product. It may contain software bugs, hardware limitations, or performance issues not present in the final version. The product is provided "as is" without warranty of any kind, express or implied.

16. Ownership and Feedback

The Lumo SafetyLight hardware becomes your property upon completion of the 60-day trial period (subject to your right to return it). The device is non-transferable during the trial period but may be transferred afterward. All software, firmware, intellectual property, trademarks, and related materials — including U.S. Patent No. 12,374,208 — remain the property of Nomo Innovations LLC. You agree not to reverse-engineer, disassemble, decompile, or otherwise attempt to derive, copy, or reproduce the design, hardware, firmware, or source code of the Lumo SafetyLight, and not to sell, lend, or transfer the device to any person or entity for those purposes. Any permitted transfer of the device remains subject to these restrictions, which survive the end or termination of the trial and continue for as long as you possess the device, whether or not you continue a subscription. Any feedback or suggestions you provide may be used to improve the product without additional compensation.

17. Returns, Withdrawal, and Termination

You may withdraw from the trial and return the device at any time before your 60-day trial ends, for any reason, using a prepaid return label we provide, and we will refund your $7.95 shipping & handling fee. Contact support@lumosafetylight.com to receive the label. If you keep the device past the end of the trial, it is yours to keep (see Section 6) and the $7.95 shipping & handling fee is not separately refunded.

Nomo Innovations LLC may end the trial program or modify its terms with 14 days' notice via email. Material changes will not apply retroactively. If the program ends early, participants who have activated their devices will retain ownership of the hardware.

18. Limitation of Liability

To the fullest extent permitted by law, the Lumo SafetyLight and related SafeWatch alert service are provided "as is" and "as available," without warranties of any kind, express or implied.

Nomo Innovations LLC does not guarantee uninterrupted operation, error-free performance, or that the device or service will detect all activity, inactivity, emergencies, or health-related events. The participant acknowledges and agrees that:

·            The Lumo SafetyLight is not a medical device, emergency response system, life-safety device, or a substitute for in-person care, supervision, or emergency services.

·            Alerts and reports confirm activity, not wellbeing, are intended solely to provide informational awareness and peace of mind, and should not be relied upon as the sole means of monitoring a person's safety or wellbeing.

·            Except in cases of gross negligence or willful misconduct, Nomo Innovations, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of service, or loss of use, even if advised of the possibility of such damages.

·            Nomo Innovations LLC shall not be responsible for failures caused by internet connectivity issues, cellular carrier outages, power interruptions, user configuration errors, or third-party services.

19. No Emergency Monitoring

The participant acknowledges that the Lumo SafetyLight does not contact emergency services and does not replace 911 or any other emergency response, medical alert, or life-safety system. By completing your order and setup, you confirm that you have read, understood, and acknowledged this limitation.

20. Eligibility and Geographic Restrictions

Participation is limited to residents of the United States who are 18 years of age or older. The SafeWatch alert service requires good WiFi coverage and may not function in all geographic areas. Minors may not participate. Parents, guardians, or adult caregivers may participate on behalf of their household, but only adults may agree to these terms.

21. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions.
