Scope — what these terms cover
These Terms of Use apply to everyone who visits our Shopify store (lumosafetylight.com) or capture page (go.lumosafetylight.com), and to use of the Lumo SafetyLight product (“the Product”). Two related documents also apply:
· Your reservation/purchase is governed by the Founding Reservation Terms.
· Your personal information is governed by the Privacy Policy.
If these Terms conflict with the Founding Reservation Terms on a reservation-specific matter (price, charge timing, cancellation), the Reservation Terms govern; on all other matters, these Terms govern.
Product names. Our product’s full name is “Lumo SafetyLight”; we also call it “Lumo.” Both refer to the Product defined above. The company that makes and sells it is Nomo Innovations LLC (“we,” “us,” or “our”).
1. Acceptance
By accessing our store or capture page, or by using the Product, you agree to these Terms of Use. If you don’t agree, please don’t use them.
2. Changes to these terms
We may update these Terms. We’ll post the current version with its effective date, give notice of material changes, and changes are not retroactive.
3. What Lumo is — and isn’t
Lumo SafetyLight is a wellness-monitoring aid, not an emergency or medical device. It shows activity, not wellbeing — it reports that a room saw normal movement, not that a person is okay. It does not call for help, contact 911, or detect falls, and should not be relied on as a sole safety system.
4. No medical or professional advice
Lumo provides activity and awareness information only. It does not provide medical or health advice, diagnosis, or monitoring, and is not a substitute for professional care, in-person supervision, or emergency services. You should seek advice from a licensed professional for any medical or health concern.
5. Disclaimer of warranties
To the fullest extent permitted by law, the Lumo SafetyLight and the monitoring service are provided “as is” and “as available,” and Nomo Innovations LLC disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Product or service will be uninterrupted or error-free, or that it will detect all activity, inactivity, emergencies, or health-related events.
6. Limitation of liability
To the extent permitted by law, Nomo Innovations LLC and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of use, arising from your use of or inability to use the Product, the monitoring service, or our store or capture page — even if advised of the possibility. Except for liability that cannot be limited by law (such as gross negligence or willful misconduct), our total liability will not exceed the amount you paid us for the Product. This applies whether the claim is based on contract, tort, negligence, strict liability, or any other theory.
7. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nomo Innovations LLC and its affiliates and their officers, agents, and employees from third-party claims, losses, and reasonable attorneys’ fees arising out of your misuse of the Product or your breach of these Terms.
8. Your information
We collect limited personal information (for example, your email, name, payment token at our processor, and the caregiver phone number(s) you provide) to operate the reservation and the service. How we handle it — and the choices you have — is described in our Privacy Policy. We do not sell your personal information.
9. Our content and trademarks
The content on our store and capture page — text, graphics, images, and the “Lumo SafetyLight” name and logo — is owned by or licensed to Nomo Innovations LLC and is protected by U.S. copyright and trademark law. You may not copy, reproduce, or use our content or marks without our prior written permission, except for normal personal viewing.
10. Device software (firmware) license
The Lumo SafetyLight contains embedded software (“firmware”) that is owned by Nomo Innovations LLC and protected by U.S. copyright and patent law, including U.S. Patent No. 12,374,208. We grant you a limited, non-exclusive, non-transferable license to use the firmware solely as embedded in the device you obtain, for its intended purpose. You may not copy, extract, modify, translate, reverse-engineer, decompile, disassemble, or create derivative works from the firmware, or attempt to derive its source code or design — except to the extent this restriction is prohibited by applicable law (for example, where the law permits reverse engineering for interoperability). The firmware is provided under the same “as is” disclaimer (§5) and limitation of liability (§6) stated above.
11. Accuracy of content and pricing
Our store and capture page may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We may correct any error and change or update information at any time without prior notice.
12. United States only
Our store, capture page, and Product are intended for use in the United States. If you access them from elsewhere, you do so on your own initiative and are responsible for compliance with local laws.
13. Governing law and dispute resolution
· Governing law: Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
· Arbitration: Any dispute between you and Nomo Innovations LLC will be resolved by final and binding individual arbitration under the AAA Commercial Arbitration Rules (and the AAA Consumer Arbitration Rules where applicable), not in court. You and we waive a jury trial and waive any class or representative claims.
