Product names used in these Terms

“Lumo SafetyLight” is the full name of our product; for convenience, these Terms also refer to it simply as “Lumo.” Both names mean the same product. The company that makes and sells it is Nomo Innovations LLC (“we,” “us,” or “our”).

1. What a reservation is

Reserving a Lumo SafetyLight holds your place in our first production run and locks your founding price. It is a reservation, not a completed sale. Lumo is still in its final in-home testing phase and is not yet shipping. Units are expected to ship in early 2027, and only if we decide to move forward to production.

2. What you pay, and when

·           You are not charged today. Your payment card is securely saved by our payment processor to hold your reservation and your founding price. No payment is taken now.

·           You’re charged only if and when we ship you a unit — at the $49 founding price — and we’ll email you a firm ship date and the exact amount before any charge is made.

·           Price lock: your $49 founding price is honored even if our regular launch price ($69) takes effect later.

·           Limited quantity: the $49 founding price is available to the first 250 reservations. After that, reservations are at the then-current price.

·           Pricing accuracy: prices, availability, and offer details may occasionally contain errors or change. We may correct any error, inaccuracy, or omission and update this information at any time, including after a reservation is placed. If a correction would affect your reservation, we’ll tell you before any charge and you may cancel at no cost.

3. Cancelling and refunds

·           Cancel anytime before we ship, for any reason, at no cost — just reply to any of our emails [or use the cancellation link in your account]. Because nothing has been charged, there’s nothing to refund.

·           After a unit ships: you may return your Lumo within [30] days of delivery for a refund of [the purchase price, minus return shipping], as long as the device is in good working condition.

4. If we don’t move forward

If we decide not to launch, or testing isn’t successful, you are never charged, and we’ll let you know.

5. The monitoring service (subscription)

·           Lumo’s text alerts and SafeWatch windows are provided through a monitoring subscription of $4.99/month.

·           The subscription begins when your device is activated, not when you reserve.

·           It renews automatically each month until you cancel. You can cancel anytime [in your account or] by emailing support@lumosafetylight.com. Your monitoring service then continues through the end of the current billing month and does not renew

·           The nightlight itself continues to work without an active subscription; the automated texts and alerts require an active subscription.

6. Text messages and your information

·           By providing one or two caregiver cell numbers, you confirm you’re authorized to receive (or to enroll those numbers to receive) text messages from Lumo. Message and data rates may apply.

·           Lumo uses a passive motion sensor — no camera, no microphone. It collects motion activity (including timestamps) and the phone numbers you provide, in order to send your recaps and alerts.

·           How we handle your information is described in our Privacy Policy. We do not sell your personal information.

7. What Lumo is — and isn’t (and our liability)

What it is. Lumo SafetyLight is a wellness-monitoring aid, not an emergency or medical device. It shows activity, not wellbeing — it reports that a room saw normal movement, not that a person is okay. It does not call for help, contact 911, or detect falls, and should not be relied on as a sole safety system.

No medical or professional advice. Lumo provides activity and awareness information only. It does not provide medical or health advice, diagnosis, or monitoring, and is not a substitute for professional care, in-person supervision, or emergency services.

Disclaimer of warranties. To the fullest extent permitted by law, the Lumo SafetyLight and the monitoring service are provided “as is” and “as available,” and Nomo Innovations LLC disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the product or service will be uninterrupted or error-free, or that it will detect all activity, inactivity, emergencies, or health-related events.

Limitation of liability. To the extent permitted by law, Nomo Innovations LLC and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of use, arising from your use of or inability to use the product, the monitoring service, or the website — even if advised of the possibility. Except for liability that cannot be limited by law (such as gross negligence or willful misconduct), our total liability will not exceed the amount you paid us for the product. This applies whether the claim is based on contract, tort, negligence, strict liability, or any other theory.

Indemnification. To the extent permitted by law, you agree to indemnify and hold harmless Nomo Innovations LLC and its affiliates and their officers, agents, and employees from third-party claims, losses, and reasonable attorneys’ fees arising out of your misuse of the product or your breach of these terms.

These Reservation Terms are part of our broader Terms of Use and Privacy Policy, which also apply to you. If these Reservation Terms conflict with the Terms of Use on a reservation-specific matter (price, charge timing, cancellation), these Reservation Terms govern; on all other matters, the Terms of Use govern.

9. Changes, governing law, dispute resolution, contact

·           Changes: We may update these terms; we’ll post the current version with its effective date. We’ll give notice of material changes, and for the subscription any material change will follow applicable auto-renewal notice rules; changes are not retroactive.

·           Governing law: Commonwealth of Pennsylvania, without regard to conflict-of-law rules.

·           Dispute resolution (arbitration): Any dispute between you and Nomo Innovations LLC will be resolved by final and binding individual arbitration under the AAA Commercial Arbitration Rules (and the AAA Consumer Arbitration Rules where applicable), not in court. You and we waive a jury trial and waive any class or representative claims.
